When the award is irregular

Deadlines are very short — typically six business days in the federal regime — so the decision to challenge must be made almost immediately, with the file already built.

What can I do if I lose a tender irregularly?
File a bid protest against the award within the legal deadline — six business days in the federal regime from the notice — pointing out the violations of the tender rules or the law. The protest can suspend the signing of the contract. Against its resolution, annulment proceedings and amparo are available.
Can I participate in tenders as a new or small company?
Yes. The law allows proving experience and capacity through consortia (joint bids) and subcontracting in certain cases. The key is reading the tender rules with a legal eye: many requirements admit alternative means of compliance, and clarification meetings exist precisely to open those doors.
What are the risks of breaching a government contract?
Beyond contractual penalties and enforcement of guarantees, breach can lead to administrative rescission and debarment from contracting with the entire public sector. At the first signs of conflict, document everything and negotiate amendments in time, before the agency starts the rescission.
